Without prejudice, the reservation and purchase of products
and/or services from ChiangMai-Hotel-Resort , the brand name
of ChiangMai-Hotel-Resort , are subject to the following terms
and conditions and other terms imposed by our partners or
affiliates from time to time. By using this site, effecting
any reservation or purchase of any product or service with
ChiangMai-Hotel-Resort , you agree to be bound by the Terms
and Conditions specified in this Agreement and those terms
of the respective third party providers, distributors, partners
and affiliates, as the case may be.
By effecting a reservation or purchase, you also represent
and warrant that you are of sufficient legal age and capacity
to create binding legal obligations in relation to the access
and use of our products and/or services. All information
supplied by you is true, current, complete and accurate.

Availability of Products and Services
You acknowledge that the availability of the products and/or services
on this website does not constitute an offer by ChiangMai-Hotel-Resort
and/or its third party providers, distributors, partners and affiliates.
All requests and reservations are subject to confirmation.
Acceptance of any request for the products and/or services
made by you is purely at the discretion of ChiangMai-Hotel-Resort.
In the event the products and/or services described cannot
be provided due to delays or any other reason beyond the
control of ChiangMai-Hotel-Resort,ChiangMai-Hotel-Resort will exercise
all reasonable efforts to arrange alternative comparable
products and/or services. Where the product and/or service
provided is either not available or our suggested alternative
is not acceptable to you but is fully paid, we shall make
a refund in accordance with our refund policy.

Cancellations
ChiangMai-Hotel-Resort reserves the right to cancel any reservations and
recover any costs incurred in so doing, if you fail to make full
payment or accept suggested alternative product and/or service (where
applicable) by the specified due date.,
In the event of any cancellation, the following
cancellation fees/penalty will be levied. This cancellation
fee/penalty is not contingent on the period/season (high
season, peak season, low season) on the dates on which the
cancellation or no-show occurred.

Reservation Amendments
For amendments to confirmed reservations, ChiangMai-Hotel-Resort reserves
the right to apply an amendment fee of THB500 per amendment. Any
amendments to reservations will be subject to the applicable package
price at the time of change.

Rates and Prices
Prices shown are in Thai Baht (THB) based on rates in effect at the time
of printing and are subject to change without notice. Peak period
surcharges and minimum night stays may apply depending on your reservation
dates.
The rates quoted are subject to local government and goods & service
taxes as applicable. You agree to pay all local and other governmental
taxes due for rental and services. All amounts quoted are exclusive of
such taxes unless otherwise stated.
Where applicable, you may make payment for your reservation in any one
of the currencies indicated. ChiangMai-Hotel-Resort reserves the right to
determine the exchange rates of the supported currencies. ChiangMai-Hotel-Resort
shall not be held liable for any exchange rate losses incurred by you
as a result of any transaction effected. |

Payments
All reservations are to be made through Credit Card. American Express,
Visa and MasterCard are accepted. The credit card selected for payment
will be charged for the total price for the reservation.
Once a reservation is made, you irrevocably authorize ChiangMai-Hotel-Resort
to charge to your credit card the full rate/charges applicable for
the reservation.

Travel Requirements
It is your sole responsibility to ensure that you have all the necessary
papers and visas required for travel. ChiangMai-Hotel-Resort will not
be held liable for any delays or failures arising.

Refund Policy
Refunds will be made at the discretion of ChiangMai-Hotel-Resort only if:
i. The product or service provided by ChiangMai-Hotel-Resort
and respective third party providers, distributors, partners
and affiliates has been fully paid for; is not available;
and the suggested alternative is not acceptable; or ii. You
cancel your reservation / request with ChiangMai-Hotel-Resort
within the time period permitted for refunds as stipulated
in cancellation policy.

in cancellation policy.
No refunds will be made on unused or partially used features
and services.

Reservations Disclaimer
All rates are subject to applicable government taxes and service charges,
and may be changed without prior notice (unless indicated otherwise).
All reservations are subject to availability at the time of reservation.
The prices quoted do not include any form of transportation (unless
stated otherwise); travel insurance; items of a personal nature;
excess baggage charge, and gratuities.
ChiangMai-Hotel-Resort reserves the right to disclose your personal information
and credit card details to the respective third party providers, distributors,
partners and affiliates to secure/guarantee your reservation. Claims
and refunds are subject to the cancellation policies of the respective
hotels. |

Disclaimer and Limitation of Liability
All transactions concluded on this website is on a caveat emptor basis,
you are advised to make your own independent inquiries in respect
of the products and services provided.
You agree that in no event shall ChiangMai-Hotel-Resort or any third party
providers and distributors be liable for any injury, loss, claim, damage,
or any special exemplary, punitive, direct or indirect, incidental or
consequential damages of any kind. Whether based in contract, strict
liability, tort or otherwise, which arises our of or is anyway connected
with (1) any use of this site or content found herein, (2) any failure
or delay (including, but not limited to the use of or inability to use
any component of this site for reservations), or (3) the performance
or non-performance by ChiangMai-Hotel-Resort or any third party providers
and distributors, including but not limited to, non-performance resulting
from bankruptcy, reorganization, insolvency, dissolution or liquidation
even if such party has been advised of the possibility of damages to
such parties or any other party.
If, notwithstanding the foregoing, ChiangMai-Hotel-Resort or any third party
providers or distributors should be found liable for any loss or damage
which arises out of or is in any way connected with any of the above
described functions or uses of this site or its content, the liability
of ChiangMai-Hotel-Resort and any third party providers, distributors, partners
and affiliates, shall in no event exceed, Thai Baht THB 2500.00 (Thai
Baht Two Thousand Five Hundred Only), whichever is lower.In the event
the services or accommodations described cannot be provided due to delays
or any other reason beyond the control of ChiangMai-Hotel-Resort, ChiangMai-Hotel-Resort
will exercise all reasonable efforts to arrange alternative comparable
services or accommodations. However, ChiangMai-Hotel-Resort will not be
liable for, and customer hereby waives all claims against ChiangMai-Hotel-Resort,
for any failure of performance by any other transportation company, lodging
property, agency or any other third party providing services hereunder.
The disclaimer and limited liability of ChiangMai-Hotel-Resort as set out
in this Agreement are fundamental elements of the basis of the bargain
between you and ChiangMai-Hotel-Resort, and you agree that ChiangMai-Hotel-Resort
would not otherwise be able to offer the products and services on its
present basis without such limitations. This clause shall survive any
termination of this Agreement.

Force Majure
ChiangMai-Hotel-Resort and any third party providers, distributors, partners
and affiliates, shall not be liable for damages of any kind arising
out of any failure or delay in performing any or all of obligations
contained herein or in respect of any product or service
if the failure or delay is due to circumstances or cause beyond our
reasonable control.

Governing Law
This Agreement shall be governed by and construed in accordance with
the laws of The Kingdom of Thailand and you submit to the non-exclusive
jurisdiction of the courts of The Kingdom of Thailand.
